The following Terms and Conditions apply to all bookings made on this website. We kindly ask that you take a moment to read them prior to making a Booking.

The Company enters into this Agreement as principal for Bookings made for the hotels it owns and as agent where a Booking is made for a hotel that it operates on behalf of the Hotel Owner. The booking confirmation will clearly state the identity of the Owner.

In these Terms and Conditions the following definitions apply:

  • You or Guest: The person who makes a booking or registers to stay at 8 Dyer Hotel
  • 8 Dyer, 8 Dyer Hotel or the Company: The provider of accommodations and amenities at 8 Dyer Hotel, its employees and officers
  • The Site: Any website operated by or on behalf of 8 Dyer Hotel

1. Guests

8 Dyer Hotel is a small, boutique inn in Provincetown, Massachusetts, embracing a diverse mix of guests. Our rooms are limited to a maximum of two guests per room and we cannot accommodate any children under the age of 18. We also cannot accommodate any pets. We do have one accessible room (Room 8) for those guests who temporarily or permanently experience a physical disability.

For the comfort of our guests, the entire property is smoke-free. Anyone who smokes on the premises will be asked to find other accommodations and will be assessed a $250 cleaning fee. Candles are not permitted in guest rooms.

2. Vehicles

Parking is on a first-come, first-served basis, however there is generally sufficient compact parking for each room to park one car. We do retain keys of cars on the premises in order to afford other guests access to their vehicles. Because parking is complimentary and voluntary, vehicle owners are liable for any damage done by their vehicle and the Hotel is not liable for any damage done to any vehicle on the property.

Provincetown is a very pedestrian-friendly town and we offer bikes for the complimentary use of our guests. Should you need to use your vehicle with some frequency, we recommend that you choose to park in a nearby municipal lot where you can have free access to your vehicle. Guests are liable for any damage done by their operation of the bicycle and should the bicycle be lost or stolen while in their custody, the guest will be liable for the full replacement value of the bicycle.

3. Reservations & Deposits

8 Dyer Hotel operates year-round but closes from time-to-time for maintenance or if occupancy is low. Rates vary according to season, and sometimes, day of the week.

Generally there is a two-night minimum stay required. During certain periods such as holiday weekends and themed weeks like Carnival and Bear Week, longer minimum stays are required. Our reservation system will alert you to any applicable minimum stays.

8 Dyer Hotel requires a 50% deposit at the time of booking to secure your reservation. Any reservation for less than two nights will be charged in full at booking, as well as any reservation made less than 21 days before the arrival date, per the cancellation policy.

4. Cancellation and No Shows

Cancellations are permitted up to 21 days before arrival. All cancellations must be made in writing via email to 8 Dyer Hotel at info@8dyer.com. A fee equal to 10% of the total reservation will be charged for all cancellations. If you cancel less than 21 days before arrival, you will forfeit your deposit. Additionally, if you cancel less than 3 days before your check-in day or fail to arrive on the day you are scheduled to check in without contacting us, you will be deemed a “No-Show” and charged the full balance of the reservation. 5. Check in and Check out

We look forward to greeting you for check in between the hours of 2 – 6 p.m. When you make your reservation, we inquire about your arrival time so we can do everything to accommodate your arrival. If you arrive earlier than 2 p.m., you are welcome to leave your luggage and begin your vacation and even enjoy the inn’s amenities. If you arrive after 6 p.m., we will provide you instructions to find your self check-in package.

Check out is at 11 a.m., however, guests are welcome to leave their luggage and even to use our pool and Jacuzzi and common shower before you head out. Parked vehicles may be accommodated if space permits.

6. Force Majeure

The Company accepts no liability and will not pay any compensation where the performance of its obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond its reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of God, acts of terrorism, fire or failure of electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures. The failure of a guest to have access to, or to use, any amenity shall not be grounds for compensation.

7. Limitation of Liability

The Company will not be responsible for the loss or damage of any property left in the Hotel other than as required under Massachusetts or any other applicable law.

The Company will not be liable for any indirect, consequential or pure economic loss or any loss of profit, goodwill or opportunity (whether caused by the negligence of the Company, its employees, contractor or agents or otherwise). The Company’s total liability shall not exceed the value of the charges received by it under the Contract.

8. Governing Law and Jurisdiction

The Contract and any non-contractual obligations arising in connection with it are governed by Massachusetts law.

The Massachusetts courts have exclusive jurisdiction to determine any dispute arising in connection with the Contract, including disputes relating to any non-contractual obligations and parties all agree to exclusive venue in Barnstable County, Massachusetts.

Each party irrevocably waives any objection which it may now or later have to proceedings being brought in the English courts (on the grounds that the English courts are not a convenient forum or otherwise).

9. Indemnification

You agree to indemnify and hold 8 Dyer Hotel and its subsidiaries, affiliates, officers, directors, agents and employees harmless from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of Your breach of this agreement or the documents it incorporates by reference, or Your violation of any law or the rights of a third party. 8 Dyer Hotel’s failure to act with respect to a breach by You or others does not waive its right to act with respect to subsequent or similar breaches.

10. Web Site Information and Copyright Notice

While all reasonable efforts have been taken to ensure the accuracy of information on the Websites, the Company does not accept responsibility for errors or omissions and reserve the right to amend, cancel or vary any of the arrangements featured on the Websites without notice. Please note that in certain circumstances, generic photographic images have been used to represent the general style of a particular product or hotel.

The content of the Websites is the copyright of the Company, and may not be copied, reproduced, published, distributed or amended for any other purpose without our prior written consent.

Trademarks used on the Websites are the property of the respective owners. Hyperlinks to third party websites are provided for your convenience. We cannot accept responsibility for the content or use of third party sites.

The Site is operated by the Company.

11. Use of Site

The services of this Site are available only to individuals who can form legally binding contracts under applicable law, and thus, are not available to minors. By using this Site, You represent that You are of sufficient legal age to use this Site and to create binding legal obligations for any liability You may incur as a result of the use of this Site. You also warrant that You are legally authorized to make the travel reservations and/or purchases for either Yourself or for another person for whom You are authorized to act.

You may only use this Site to make legitimate reservations or purchases and shall not use this Site for any other purposes, including without limitation, to make any speculative, false or fraudulent reservations, or any reservation in anticipation of demand.

This Site is to be used by You for Your personal use only. Commercial uses of this Site are strictly prohibited unless prior written consent from the Company has been granted. You agree that You will not use this Site for chain letters, junk mail, “spamming”, solicitations (commercial or non-commercial) or bulk communications of any kind including but not limited to distribution lists to any person who has not given specific permission to be included in such a list. In addition, You agree not to create a hypertext link from any web site controlled by You or otherwise, to this Site without the express written permission of the Company. You agree not to pretend to be any other person or a representative of any entity, whether actual or fictitious, including an employee or agent of 8 Dyer Hotel or any third party that provides services related to this Site.

You agree that You will not use any robot, spider, other automatic device or manual process to monitor or copy the Site or any contents or information contained therein, unless You obtain the Company’s prior express written consent. You agree that You will not through any means interfere or attempt to interfere with the proper functioning of the Site. You agree that You will not provide to 8 Dyer Hotel and/or to this Site: (i) any viruses, worms, time bombs, and/or other computer programming routines that are intended to damage, detrimentally interfere with, intercept or expropriate any system, data or information; and (ii) any content that may create liability for the Company or cause the Company to lose (in whole or in part) the services of our suppliers.
